Ram Chandra Goswami v. The State of Assam and 4 Ors

ORDER Date : 27-03-2024 Heard Mr. B.D. Konwar learned senior counsel assisted by Ms. P Gupta learned counsel for the petitioner. Also heard Mr. H Sarma learned additional senior government advocate appearing for respondent Nos.1 and 2. The grievance of the petitioner is with regard to non constitution of Maintenance Tribunal envisaged under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. On instructions Mr. H Sarma learned Additional Senior Government Advocate submits that by notification dated 02.08.2008, the Tribunal has already been constituted and all the District Social Welfare Officers of Assam has been notified as Maintenance Officers in their respective districts. In that view of the matter, Mr. B.D. Konwar learned senior counsel for the petitioner submits that a direction may be issued to Page No.# 3/3 the competent authority to dispose of the grievance of the petitioner. As the maintenance tribunal has already been constituted, the petitioner shall be at liberty to approach such tribunal raising his grievance. In the event such grievance is raised, the same be considered and disposed of as per law within a reasonable period of time. Writ petition stands disposed of accordingly.
