Heard Mr. GN Sahewalla, the learned senior counsel assisted by Ms. S Todi, the learned counsel appearing on behalf of the petitioners. The learned senior counsel appearing on behalf of the petitioners/plaintiffs submitted that taking into account the reliefs at Clauses b) and c) of the Commercial Suit No.02/2023 he is not pressing the instant petition. Accordingly the instant petition, therefore, stands closed on withdrawal. Before parting with the records, this Court opines that taking into account that new defendants have been impleaded in the Commercial Suit, the learned Trial Court shall decide the said suit within the timeline as permitted under the law.
