Heard Mr. B. Purkayastha, learned counsel for the petitioners. Also heard Mr. H.Terangpi, learned Standing Counsel, Secondary Education Department appearing for all the respondents.

¶2Having regard to the projection made by the petitioners, the writ petition is taken up for disposal at the motion stage.

¶3By filing this petition, the petitioners prays for a direction to the respondent authorities to grant one increment on account of the petitioners having acquired B.Ed Degree in terms of the Communication dated 21.07.2016 (Annexure 5), wherein it has been provided that all Assistant Teachers are eligible to get one advanced increment for acquiring B.Ed Degree provided that Page No.# 4/4 he/she has joined before 03.07.2012 and obtained B.Ed Degree from UGC recognized University and NCTE approved B.Ed College.

¶4Mr. B. Purkayastha, learned counsel for the petitioners submits that the petitioners needs the aforesaid requirements and therefore, is entitled to be given one increment. The learned counsel for the petitioners also draws the attention of this Court to Annexure 8 of the writ petition wherein this Court in a case of similar nature has granted such similar benefit namely, Order dated

13.12.2023 passed in WP(C)/7178/2023 (Pranjit Sarma and 10 Ors Vs State of Assam and 3 Ors).

¶5Having regard to the aforesaid submission and the materials available on record, this writ petition is disposed of with a direction to the respondent No.3 to examine the claim of the petitioners and upon such examination, if the petitioners are found eligible to be given the increment of pay in terms of the communication dated 21.07.2016, the same shall be given to them without any delay.

¶6To enable the respondent No.3 to consider the claim of the petitioners, the petitioners shall submit a copy of this writ petition along with a certified copy of this order to the respondent No.3. This exercise will be done within a period of 1

(one) month from the date of receipt of the same.

¶7Writ petition is accordingly disposed of.
