Judgment

ORDER

19.03.2024 Heard Mr. A Hussain, learned counsel for the petitioners as well as Ms. A Begum, learned Additional Public Prosecutor, Assam. This is the 2nd application filed under Section 438 CrPC seeking anticipatory bail by the petitioners, namely, Afcher Ali and Asmina Khatun in connection with Boko P.S. Case No. 426/2023 registered under Sections 313/304/34 IPC. The earlier bail application was rejected by this court after perusing the case diary on 19.01.2024. After hearing the learned counsel for the petitioners and after perusal of the materials, available on record, it is seen that no new ground has been shown while seeking anticipatory bail by the petitioners for the second time. Therefore, the prayer for pre-arrest bail is rejected. With the above, the bail application is dismissed and disposed of accordingly.
