Nur Amin Ali @ Nituraj v. The State of Assam and Anr

ORDER Date : 21.03.2024 Heard Mr. M. Khan, learned counsel appearing for the Petitioner. I have Page No.# 2/2 also heard Mr. D.P. Goswami, the learned Additional P.P. for the State of Assam and Mr. K.R. Patgiri, learned counsel appearing for the respondent No. 2/informant. This is an application under Section 438 of the Cr.P.C. in respect of Manikpur P.S. Case No. 26/2024 registered under Sections 420/406/295(A) of the Indian Penal Act read with Section 66(D) of the Information Technology Act. The petitioner got introduced to the informant through face book. The petitioner is a Muslim by religion but he introduced himself to the informant as a Hindu. This fact came to be known to the informant subsequently. Therefore, she stopped communicating with him. It is submitted that the petitioner opened a fake face book account in her name and made viral some obscene photographs. Today, learned counsel for both sides have submitted that both sides have settled their disputes between themselves and to that effect the informant has filed an affidavit in this case. Since both sides have settled their disputes between themselves, the present petitioner does not deserved to be detained in custody. Therefore, it is hereby directed that in the event of arrest in connection with Manikpur P.S. Case No. 26/2024, the petitioner Nur Amin Ali @ Nituraj shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the arresting authority.
