Judgment
ORDER Date : 27.03.2024 Heard Mr. M. Kalita, learned counsel appearing for the Petitioner. Also heard Mr. R.J. Baruah, the learned Additional P.P. for the State of Assam. This is an application under Section 439 of the Cr.P.C. in respect of Pathsala All Women P.S. Case No. 81/2023 under Section 379 of the Indian Penal Code read with Sections 66(C)/66(D) of the I.T. Act Page No.# 2/2 The informant alleged that the present petitioner had ported the phone number of the informant and in that manner he had withdrawn the money from the bank account of the informant. Mr. Baruah submits that though some amount of money has been recovered from the possession of the petitioner, the remaining amount of the money is yet to be recovered. I have considered the submissions made by the learned counsel for both sides. Since there are incriminating materials against the petitioner in the case diary, the prayer for bail stands rejected. The bail application stands disposed off.
