National Insurance Company Ltd v. Foize Uddin Barbhuiya and 2 Ors

ORDER Date : 11.05.2024 The case is put up before the National Lok Adalat. The appellant, National Insurance Company Limited is represented by Ms. Mery Pegu, Regional Manager of the said Company. The respondent/claimant Foize Uddin Barbhuiya is also personally present before this Court. The original award amount was Rs. 4,63,000/-. This case has been mutually settled between the parties at an amount of Rs. 9,66,000/-. Out of the total amount, the Insurance Company has already been deposited an amount of Rs. 8,17,500/- to the Registry and Rs.1,48,500/- remains to be paid to the claimant. The claimant has already received an amount of Rs.5,86,000, out of the total agreed amount. In pursuant to the amicable settlement arrived at between the parties, the Insurance Company is directed to deposit the remaining amount of Rs. 1,48,500/- to the Registry of this Court within a period of 45 days from the date of this order and on such deposit, the Registry shall disburse the an amount of Rs. 3,80,000/- to the claimant on proper verification of their identity as well as verification of their bank details. The statutory deposit, if any, deposited by the appellant, may be returned back to the appellant by the Registry of this Court. Page No.# 3/3 With above observation, this case is disposed of.
