Sri Jubul Kumar Choudhury v. The State of Assam

Heard the learned counsel for the parties. By this application under section 438 Cr.P.C., the applicant, namely, Sri Jubul Kumar Choudhury has prayed for granting pre arrest bail who is apprehending arrest in connection with Changsari PS Case Page No.# 2/2 No.65/2024 under section 407 IPC. It is submitted by the learned Addl. PP that charge sheet being CS No.52/2024 dated 10.04.2024 has already been filed by the Investigating Officer after completion of the investigation. In that view of the matter the present bail application stands disposed of by giving liberty to the applicant to appear before the learned court below by filing appropriate application seeking regular bail and in the event of filing such application, the learned court below shall consider the same in accordance with law. The interim order passed earlier shall remain in force till the applicant appears before the learned trial court on receipt of summon and seek regular bail. In the event of such appearance seeking regular bail, the same be considered as per law. Accordingly, this bail application stands disposed of.
