Naules Kumar @ Vikash v. The State of Assam

ORDER Date : 20.03.2024 Heard Mr. A. Mobaraque, learned counsel appearing for the Petitioner. Also heard Mr. R.J. Baruah, the learned Additional P.P. for the State of Assam. This is an application under Section 439 of the C.r.P.C. in respect of Mererchar P.S. Case No. 12/2024 (NGR Case No.107/2024) under Sections 342/365/387/34 of the Indian Penal Code. The occurrence took place in the State of Bihar. A person called Bahadur Ali had gone to Bihar in search of business. He was kidnapped by the two petitioners who demanded 2 lakh of Rupees. When the money was not paid properly, Bahadur Ali was forcibly detained and physically assaulted. Police arrested the present two petitioners on the spot and recovered Bahadur Ali. I find that no sufficient grounds have been pleaded to grant the privilege of bail to the petitioners. Therefore, the bail application of the Petitioners is rejected and disposed off accordingly.
