ORDER

12.03.2024 Heard Mr. D Chakrabarty, learned counsel for the applicant/petitioner who submits that by filing this application the applicant seeks withdrawal of the writ petition. [2.] Referring to the paragraph No. 3 of the application, the learned counsel submits that the same is the reason for withdrawing the writ petition. Paragraph No. 3 is abstracted hereunder:- "3. That, during the pendency of the instant Writ petition, the applicants herein have arrived at an out of court settlement with the Silchar Development Authority to the extent that the applicants would be paid their arrear salaries by the Silchar Development Page No.# 3/3 Authority subject to the condition that the applicants should forgo their claim for payment of scale at higher rate and withdraw the instant Writ Petition which has been filed assailing the impugned Resolution No. 3 adopted in the 72nd Board Meeting of the Silchar Development Authority held on 23.11.2015 to the extent of declining the payment of scale at higher rate to the applicants." [2.] Mr. S P Choudhury, learned counsel representing respondent Nos. 3, 4 & 5 and he submits that he has no objection to the prayer made by the applicant. Similarly, Mr. C S Hazarika, learned counsel appearing for respondent Nos. 1 & 2 has no objection. [3.] The application seeking withdrawal of the writ petition is hereby allowed. I.A accordingly stands disposed of.
