Amphu Engtipi v. Tensing Rongpi

ORDER Date : 26-07-2024 Heard Ms. N Mahanta learned counsel for the petitioner. The present application is filed alleging willful and deliberate violation of this court's order dated 21.08.2023 passed in WP(C) Page No.# 2/2 No.357/2023. By the aforesaid order, this court without expressing any opinion on the merit of the claims and counter claims of the parties over the land in question and the prayer for mutation, directed the respondent, the Joint Secretary, Department of Revenue, KAAC, Diphu to pass appropriate order on the application dated 22.09.2022 submitted by the petitioner for mutation. Mr. J Chutia learned counsel for the respondent submits that he has already filed an affidavit taking a stand that the aforesaid order has been complied with and an order dated 27.03.2024 has been passed whereby the claim of the petitioner was not considered for pendency of a title suit. Be that as it may, as the order dated 21.08.2023 passed in WP(C) No.357/2023 is complied with, the contempt petition stands closed. However, the petitioner shall be at liberty to assail the order dated 22.09.2022 in the appropriate forum, if so advised. Registry to tag the affidavit stated to have been filed on
