ORDER Date : 18-03-2024 Heard Ms. S.B. Choudhury learned counsel for the petitioner. Also heard Mr. S Dutta learned senior counsel assisted by Mr. S Dutta learned counsel for the respondent No.2, Silchar Municipal Board. It is pleaded that the petitioner being a law abiding conscious citizen of India and a social worker has preferred the instant writ petition keeping in mind the benefit and wellbeing of the students of the Govt. Girls' Higher Secondary School, Silchar. It is the grievance of the petitioner that the Silchar Govt. Girls' Higher Secondary School has been constructed in violation of the extent norms and by laws for construction of such a building. It is the further case of the petitioner that the petitioner is representing the public of the aforesaid locality and he is ready to pay any cost, if imposed by this court. The grievance raised and the pleadings made essentially shows that it is the case of the petitioner that he is espousing a cause of public interest and he has represented the public of the aforesaid locality. At this stage the learned counsel for the petitioner submits that she may be allowed to withdraw the present writ petition with a liberty to file PIL. Prayer is allowed. Accordingly the present writ petition stands closed with liberty as sought for.
