ORDER
25.09.2024 Heard Mr. J. B. Choudhury, learned counsel appearing for the petitioner. Also heard Mr. S. Dutta, learned Standing Counsel, Revenue Department, Assam appearing for the respondent Nos.1 and 2 and Mr. T. C. Chutia, learned Addl. Senior Govt. Advocate, Assam appearing for the respondent Nos.3, 4 and 5. The writ petitioner herein had participated in the selection process initiated by the Deputy Commissioner, Nalbari for filling up 18 post of Lot Mondal vide advertisement notice dated 01.03.2023. Pursuant to the selection process, the result of the written test was also published but the outcome of the computer proficiency test has not yet been declared by the authorities. The writ petitioner is aggrieved by the fact that despite the lapse of several months, the authorities have not published the result of the selection process. Hence, this writ petition. Mr. T. C. Chutia, learned Addl. Senior Govt. Advocate, Assam submits on the basis of written instructions dated 16.08.2024 that since only 52 candidates have been shortlisted for filling up the 18 posts, the ratio of 1 : 4 as per the requirement of the Rule was not fulfilled in this case. Therefore, the District Administration has sought instruction from the Government of Assam as to the further steps that is required to be initiated in this case. From the above instruction, it is clear that this is not a case where the respondents have arbitrarily withheld the result of the selection process. Page No.# 3/3 In view of the above, this writ petition stands disposed of by providing that the respondents shall take a decision in the matter at the earliest and notify the same. It will be open for the respondents either to pursue the present selection if the same is permissible as per the Rules or to go for a fresh selection process, if so advised. Writ petition stands disposed of.
