18.03.2024 Heard Mr. N. Mahajan, learned counsel for the petitioners. Also heard Mr. D. Das, learned APP appearing for the State. This is an application under Section 438 of CrPC for granting pre arrest bail to the petitioners i.e., Rasid Ali @ MD. Roshid Ali and MD.Sadik Ali who are apprehending arrest in connection with PRC No. 527/2021 arising out of Bihpuria Police Station Case No. 206/2017. It is submitted at the bar that charge sheet has been filed in the instant case vide Charge Sheet No. 258/2020 dated 27.09.2020. Mr. N. Mahajan, learned counsel for the petitioners submits that the petitioners are willing to appear before the committal Court. Considering the aforesaid endorsement made by the learned counsel for the petitioners, this Court is of the considered view that this Anticipatory Bail Application can be disposed of with a direction that the petitioner shall appear before the Court of Judicial Magistrate First Class, Lakhimpur, North Lakhimpur within a period of 10 days and till then he shall not be arrested. Upon his appearance, the committal Court is at liberty to proceed with in accordance with law. With the aforesaid observations and directions, this Anticipatory Bail application stands disposed of.
