¶1Mr. R. C. Sancheti, the learned counsel for the Petitioner submits that he would not like to press the instant proceedings challenging the order dated

08.01.2024 passed in Misc. (J) Case No.598/2022 and Misc. (J) Case No.435/2021 arising out of Title Suit No.302/2018 passed by the Court of the learned Civil Judge (Junior Division) No.3, Kamrup (M) at Guwahati. He however submits that the withdrawal of the instant petition should not preclude the Petitioner to put objections to the documents at the time of cross-examination and the learned Trial Court to decide the admissibility of the document at the relevant point of time.

¶2Taking into account the above, the instant petition stands closed on withdrawal.

¶3The withdrawal of the instant proceedings shall not preclude the Petitioner to put objections to the documents more particularly Exhibit-3 to Exhibit-42 and Page No.# 3/3 also requests the learned Trial Court to decide the admissibility of those documents at the time of appreciation of the evidence.
