Altab Ali Moulana @ Md. Altab Hussain v. The State of Assam

Heard Mr. M. Hoque, learned counsel for the petitioner. Also heard Mr. B. Sarma, learned Additional Public Prosecutor for the State respondent who has submitted that though the case diary was called for, however in the meanwhile charge-sheet has been laid bearing charge-sheet No. 21/2023 dated 31.03.2023. Page No.# 2/2 It appears form the record that by order dated 17.03.2023, the petitioner Altab Ali Moulana @ Md. Altab Hussain was allowed to go on interim anticipatory bail by this Court with certain conditions and it is submitted by learned counsel for the petitioner that in pursuant to the directions of this Court, the petitioner has appeared before the Investigating Officer and has co-operated in the investigation. In view of laying of the charge-sheet and in view of the fact that the petitioner has complied with the directions of this court and has co-operated in the investigation, the interim anticipatory bail granted to the petitioner by order dated 17.03.2023 is hereby made absolute with condition No. 2 attached to the said order remaining intact. With the above observations, this anticipatory bail application is disposed of.
