Heard Mr. D. Borah, learned counsel for the applicant. Also heard Mr. S.C. Keyal, learned counsel for the respondent. The present Interlocutory Application has been preferred by the Assam University authorities praying for leave to declare the results of the selection held for recruitment to the post of Assistant Professor, Agriculture Engineering, which was so advertised keeping the post reserved for OBC category candidate. Page No.# 3/3 It is contended by Mr. S.C. Keyal, learned counsel for the respondent that the selection process for the said post was concluded on 27.08.2022. The recommendation of the selection committee as constituted in the matter including the marks scored by the candidates participating therein including the petitioner has been produced before this Court in a sealed cover. This Court has examined the matter and accordingly find that the selection process with regard to the post has already been concluded and considering the fact that the said post is also required to be occupied by a competent person for the interest of the students pursuing course in the said University, this Court grants leave to the University Authority to take forward the selection process and appoint the candidate so selected by the selection committee. However, while effecting such appointment, the respondent authority in the appointment order that would now be issued to the selected candidate shall reflect that the appointment would subject to the outcome of WP(C) 5524/2022, presently pending disposal before this Court. It is provided that the order of granting leave to the Assam University authority to take forward the selection process is without prejudice to the claims made by the petitioner in the present proceedings which would now be considered in the connected writ petition. In terms of the leave so granted in the matter, on appointment order being issued, Mr. S.C. Keyal, learned counsel shall furnish a copy of the said order along with the address of the selected candidate to Mr. D. Borah, learned counsel for the petitioner for doing the needful towards impleading the said person in the connected writ petition. It is also mentioned that the minutes of the selection committee as produced by Mr. S.C. Keyal, learned counsel for the University along with the marks as awarded to various candidates participating in the selection process is returned and the same would be so produced by Mr. S.C. Keyal, if so required by this court during considering the issue arising in the connected writ petition. With the above observation and directions, the I.A. stands disposed of.
