Kwrwmdao Brahma v. The State of Assam

Heard Mr. P.K Das, learned counsel for the petitioner and Mr. P Borthakur, learned Addl. PP, Assam. By this application under section 438 Cr.P.C., the petitioner, namely, Kwrwmdao Brahma has prayed for granting pre arrest bail who are Page No.# 2/2 apprehending arrest in connection with Kokrajhar PS Case No.47/2024 under sections 420/406/376 IPC. It is submitted by the learned Addl. PP that the charge sheet being CS No.67/2024 dated 23.04.2024 in connection with Kokrajhar PS Case No.47/2024 has already been filed by the Investigating Officer after completion of the investigation. In view of the aforesaid, it is provided that the interim order passed earlier by this court on 21.03.2024 in respect of the petitioner above named, shall remain in force till the petitioner appear before the learned trial court on receipt of summon and seek regular bail. In the event of such appearance seeking regular bail, the same be considered as per law. Accordingly, this bail application stands disposed of.
