Hakim Ali v. The State of Assam

O R D E R

25.04.2024 Heard learned counsel for the parties. By this application under Section 439 Cr.P.C., the petitioner, Hakim Ali, who was arrested on 28.02.2024 is praying regular bail in connection with Hatigaon Police Station Case No. 37/2024 under Section 323/376 IPC. Page No.# 2/2 Case diary as called for has been received. Perused the material available on record including the case diary produced the learned Additional Public Prosecutor. The material available on record including the injury report which fortifies the allegation and the stage of investigation does not warrant release of the petitioner on bail inasmuch as the conduct of the petitioner also fortifies the apprehension of the I/O that the petitioner may once again attack the victim. In an overall view of the matter, this court is of the considered opinion that further detention of the petitioner may be necessary and therefore the application for granting bail to the petitioner stands rejected at this stage. Accordingly, bail application stands dismissed.
