Reliance General Insurance Co. Ltd., v. Sri Abhijit Chanda and 2 Ors

Md. Menhaz Ahmed Barbhuiya, Senior General Manager of Reliance General Insurance Co. Ltd. as well as Mr. Abhijit Chanda, respondent no.1/claimant are present.

¶2After negotiated settlement, the parties have agreed for a total settlement amount of Rs.7,20,00/- (Rupees seven lakh twenty thousand only) as full and final settlement of all the claims of the respondent no.1 against the order and award dated 19.12.2018, passed by the learned Member, MACT No.2, Kamrup (M), Guwahati in MAC Case No.1623/2013. Out of the settlement amount, a sum of Rs. 2,70,255/- (Rupees two lakh seventy thousand two hundred fifty five only) has already been deposited with the Registry of this Court. However, the appellant is willing to deposit the balance amount rounded to Rs.4,50,000/- (Rupees four lakh fifty thousand only) as full and final settlement of the amount.

¶3Accordingly, the matter is settled on compromise in terms of the pre-settlement/compromise slip for the National Lok Adalat, which is made as a part of record.

¶4Both the parties shall put their signature in the pre-settlement compromise slip as token of acceptance for the settlement.

¶5Accordingly, the Reliance General Insurance Co. Ltd. shall deposit the settlement amount of Rs.4,50,000/- (Rupees four lakh fifty thousand only) in favour of the respondent no.1 before the Registry of this Court within a period Page No.# 3/3 of 30 (thirty) days from the date of the this settlement order, failing which the amount shall carry interest @ 9% per annum till the date of deposit.

¶6The amount shall be released to the respondent no.1 on satisfaction of his identity.

¶7On furnishing proof of the deposit of the entire settlement amount, the Registry shall release the statutory deposit made by the appellant.

¶8The matter is disposed of in this Lok Adalat.
