23.04.2024 Heard learned counsel for the parties. Page No.# 2/2 By this application under Section 439 Cr.P.C., the petitioners, 1. Khalil Uddin, 2. Jamir Kazi, who were arrested on 06.02.2024 are praying regular bail in connection with Sorbhog PS case No. 142/2023 under Section 392/302 IPC. Case diary as called for has been received. Perused the material available on record including the case diary produced the learned Additional Public Prosecutor. From perusal of the case diary, it is seen that there are sufficient material suggesting direct involvement of the petitioner in commission of the offence. The case diary further reveals that some of the co-accused are yet to be arrested. Considering the nature and gravity of the offence and involvement of the petitioner in commission of the offence, this court is of the considered opinion that further detention of the petitioner may be necessary and therefore the application for granting bail to the petitioner stands rejected at this stage. Accordingly, bail application stands dismissed.
