ORDER
02.08.2023 Heard Mr. S.C. Das, learned counsel for the petitioner and Ms. B. Sharma, learned CGC for the Union of India.
¶2This writ petition has been filed by the petitioner seeking a direction to the respondents to appoint him in the post of Constable(GD) in the Central Armed Police Forces in NIA/SSF and Riflemen (GD) in Assam Rifles. The petitioner belongs to the SC category and he appeared in the examination and faired well, however, his name did not figure in the select list published. Being aggrieved, he approached this Court praying for a direction to the respondents to bring out a fresh select list showing the name of the petitioner and to pass necessary orders for recruiting him to the post applied.
¶3The learned counsel for the respondents submits that similar writ petition has been disposed of by a Co-ordinate Bench. A copy of such order dated
02.06.2023 passed in W.P(C) No. 3169/2023 has been placed before this Court.
¶4The learned counsels for the parties have been heard. Pleadings have been perused. The order dated 02.06.2023 passed in W.P(C) No. 3169/2023 has also been carefully perused.
¶5In the said order, besides reference to the orders passed by the Delhi High Court as well as Tripura High Court, a reference was made to the order dated Page No.# 3/3
11.08.2022 passed in W.P(C) No. 3764/2021 by a Co-ordinate Bench of this Court. Perusal of the said order reveals that the issues involved in the said writ petition and the present writ petition are similar and the Co-ordinate Bench has already issued directions disposing of the said writ petition directing the respondents authorities to consider the case of the petitioner and appoint him in any of vacant post available.
¶6Since there is no dispute at the bar and the learned counsel for the respondents has fairly submitted that the case of the petitioner would be covered by the order passed by the Co-ordinate Bench, this Court is of the view that this writ petition can also be closed with similar directions.
¶7Accordingly, taking note of the submissions made by the learned counsels as well as the directions passed in the order dated 11.08.2022 in W.P(C) No. 3764/2021 read with the order dated 02.06.2023 passed in W.P(C) No. 3169/2023, this writ petition stands disposed of by directing the respondents to issue order of appointment appointing the petitioner as Constable (GD) in any of the divisions of Central Armed Police Forces or any other Armed Police Force as expeditiously as possible preferably within a period of six months from the date of receipt of certified copy of this order.
¶8In terms of the above observations, the writ petition stands closed.
