Roshidul Hoque v. The State of Assam

Heard the learned counsel for the parties. By this application under Section 438 Cr.P.C., the applicant, namely, Roshidul Hoque has prayed for pre arrest bail who is apprehending arrest in connection with Samaguri PS Case Page No.# 2/2 No.07/2024 under sections 120B/489(A)/489(B)/489(C) / 489(D)/489(E) IPC. Case diary called for is received and perused. From the case diary it is seen that the alleged fake Indian currency note amounting to Rs.76,500/- were recovered from the possession of one Johirul Islam and Soyeb Ali. The computer shop-of the petitioner was thereafter searched on the basis of the statement of the aforesaid accused person and certain materials suspected to be used in manufacturing and printing fake currency notes were recovered. However, the petitioner could not be arrested. Apprehending arrest the present application is filed. The materials so far collected suggests that the petitioner is one of the kingpin in manufacturing fake Indian currency notes and he had delivered fake currency notes to accused Johirul Islam and Soyeb Ali. The case diary further reveals that the investigation is at a very nascent stage. Considering the materials so far collected which suggests involvement of the petitioner, this court is not inclined to grant the privilege of pre arrest bail to the petitioner and accordingly the same stands dismissed. The case diary be returned.
