This Interlocutory Application comes upon for consideration of the prayer of the applicant for condoning the delay of 58 days in filing the connected writ appeal. Heard the learned counsel appearing for the parties. Ms. A. Das, learned Standing Counsel, Secondary Education Department, appearing for respondents No. 1, 2 and 3 has no objection if the delay is condoned. However, Mr. K. Boruah, learned counsel for the respondent No. 4 has submitted that the applicant has failed to explain the delay satisfactorily. Having heard the learned counsel for the parties and after going through the contents of the Interlocutory Application, we are of the view that the delay of 58 days occasioned in filing Page No.# 3/3 the connected appeal is liable to be condoned. Accordingly, the Interlocutory Application is allowed. The delay of 58 days in filing the connected appeal is condoned. Registry is directed to register the connected appeal and list it before this Court for admission after two weeks. Interlocutory Application stands disposed of.
