26.04.2024 Heard Mr. S M Mollah, learned counsel for the petitioners. Also heard Mr. KK Parasar, learned Additional Public Prosecutor, Assam. Page No.# 2/2 This is an application under Section 438 Cr.P.C., praying for grant of pre-arrest bail to the petitioners, 1. Nurjahan Khatun and 2. Monowara Khatun in connection with Bhangagarh PS case No. 22/2024 under Section 302/34 IPC. Case diary as called for has been received. Perused the material available on record along with case diary. After perusal of the case diary, this court has not find any serious incriminating material warranting custodial interrogation of the petitioners. Considering the material available on record, this court is of the view that the petitioners have made out a case for grant of anticipatory bail. Accordingly, this application stands allowed. It is provided that in the event of arrest, the petitioners namely, 1. Nurjahan Khatun and 2. Monowara Khatun shall be allowed to go on pre-arrest bail on furnishing a bond of Rs. 20,000/- each with one local surety of like amount to the satisfaction of the arresting authority on the conditions that: I. The petitioners shall appear before the Investigating Officer within a period of 10 days from today and get their statements recorded, II. The petitioners shall not hamper with the investigation or temper with the evidence of the case, III. The petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer, IV. The petitioners shall appear before the I/O on each and every date as and when called for. Bail application stands disposed of. JUDGE Comparing Assistant
