Heard Mr. D.K. Bhattacharyya, learned counsel for the applicant-appellant and Ms. S. Jahan, learned Additional Public Prosecutor, Assam for the State respondent. Page No.# 2/2 Mr. Bhattacharyya, learned counsel for the applicant-appellant by drawing attention of this Court to Annexure-1 of the additional affidavit, filed on 20.04.2024, has submitted that as per the said Cadaver Report, the applicant-appellant, Bablu Das has expired on 14.04.2024. Ms. Jahan, learned Additional Public Prosecutor has endorsed the factum of death of the applicant-appellant, Bablu Das on the basis of the same Cadaver Report issued by the Registrar/Medical Officer of the Assam Medical College & Hospital, Dibrugarh, received by her from the concerned authority. In view of demise of the applicant-appellant, Bablu Das, on 14.04.2024, while undergoing sentence pursuant to the Judgment and Order dated 21.09.2023, the instant application stands closed.
