Anowar Hussain and 2 Ors v. The State of Assam

Heard Mr. K Islam, learned counsel for the applicants and Mr. D Das, learned Addl. PP, Assam. By this application under Section 438 Cr.P.C., the applicants, namely, 1. Anowar Hussain, 2. Azad Ali & 3. Siddik Ali have prayed for pre arrest bail apprehending arrest in connection with Bilasipara PS Case No.62/2024 under section 364 A IPC. Case diary called for is received and perused. The informant has alleged that the younger son of the applicant was kidnapped by the accused persons and they demanded ransom of Rs.2,00,000. The statement of the recovered victim clearly depicts that the accused persons kidnapped the informant's son and demanded money as alleged in the FIR, however, subsequently, FIR was lodged and police recovered the victim from a market. Considering the matter in entirety, this court is of the view that there are sufficient incriminating materials against the applicants and accordingly, this Court is of the view that this is not a fit case for grant of privilege of pre arrest bail to the applicants and accordingly the same stands rejected. Accordingly, the instant petition stands dismissed. The interim order passed earlier if any, stands vacated. Return the case diary.
