Hafijul Hoque Bepari v. The State of Assam

ORDER Date : 20.08.2024 Heard Ms. T. Begum, learned counsel for the petitioner. Also heard Mr. K. K. Parasar, learned Additional Public Prosecutor for the State of Assam.

¶2One application under Section 438 of the Code of Criminal Procedure, 1973 praying for granting pre-arrest bail in respect of P.R.C. Case No.671/2021.

¶3In the Aforesaid P.R.C. Case, the petitioner name is not shown as an accused, his name was not shown in the FIR also. Page No.# 2/2

¶4The petitioner Hafijul Hoque Bepari submits that he is not Hafijul Rahman. The petitioner submits that even then he has been wanted by Police.

¶5This Court is of the opinion that this matter should be decided by the Trial Court. The Trial Court is directed to decide this matter expeditiously.

¶6For that matter it is hereby directed that on his appearance before the Trial Court in connection with P.R.C. Case No. No.671/2021 the petitioner shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Additional Chief Judicial Magistrate, Goalpara.

¶7The bail application stands disposed of.
