Judgment
ORDER Date : 24.04.2024
Heard Mr. S Rahman, learned counsel for the applicant. Also heard Mr. K K Parashar, learned Addl. PP, Assam. By this application the applicant, namely, Churesh Bordoloi has Page No.# 2/3 prayed for pre arrest bail under section 438 Cr.P.C who is apprehending arrest in connection with Juria PS Case No.20/2024 under section 376 IPC. Case diary called for is received and perused. Having gone through the materials available in the case diary, it is seen that materials collected by the investigating agency against the applicant to implicate him in the commission of the offence are not sufficient enough to warrant custodial interrogation of the applicant. Accordingly the applicant has made out a good case for granting him pre arrest bail. As such this anticipatory bail application is hereby disposed of by providing that in the event of arrest in connection with the aforementioned case, the applicant, above named shall be released on bail on furnishing a bond of Rs.30,000/- with one local surety of the like amount to the satisfaction of the arresting authority subject to the condition that: I. The applicant shall appear before the Officer in charge of the concerned PS within 10 (ten) days from today; II. The applicant shall continue to appear before the officer in charge of the concerned PS of the above mentioned case after every 15 (fifteen) days from the date of first appearance till such time the attendance is dispensed with by the said IO. III. The applicant shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to any police officer. Page No.# 3/3 IV. The applicant shall not leave the territorial jurisdiction of the concerned I.O. without prior intimation and shall not hamper with the investigation or tamper with the evidence of the case. The pre-arrest bail application stands disposed off. Send back the case diary.
