Judgment

ORDER Date : 09.04.2024

Heard Mr. M. Ali, learned counsel for the applicant. Also heard Mr. R.J. Baruah, learned Addl. Public Prosecutor for the State respondent.

¶2This interlocutory application is preferred by the applicant, namely, Aminur Islam @ Aminul Ali, for correction/modification of the order dated 15.03.2024 in Bail Appln. No. 756/2024. Page No.# 2/2

¶3It is to be noted here that vide order dated 15.03.2024, this Court was pleased to grant the privilege of bail to the present applicant.

¶4Mr. M. Ali, learned counsel for the applicant submits that in the bail order dated 15.03.2024, the applicant has been shown as the son of one Nur Islam, resident of village Bhagdahar under Dhubri P.S., but instead of Nur Islam, the same ought to have been Nurul Islam and on account of this and also on account of mentioning the name of the father of the applicant in the forwarding report as Abul Ali, the learned Court below has not accepted the bail bond furnished by the present applicant, and therefore, it is contended to make necessary correction of the name of the father of the applicant.

¶5Having heard the submission of learned Advocates of both sides and also considering the materials on record, this Court is inclined to dispose of this interlocutory application by directing that henceforth the name of the father of the applicant in the order dated 15.03.2024, shall be read as Nurul Islam, instead of Nur Islam, resident of village Bhagdahar under Dhubri P.S.

¶6In respect of the mismatching of the name of the father of the applicant in the forwarding report, the learned Court below may call for a report from the I.O. concerned as to who is the actual father of the present applicant and thereafter on the basis of the report, may proceed to take necessary action this regard.

¶7In terms of above, this interlocutory application stands disposed of.
