¶1Heard learned counsel Mr. M.K. Hussain for the petitioner.

¶2The petitioner namely, Mashuk Uddin Laskar @ Mashuk Ahmed Laskar has filed this application under Section 439 Cr.PC with prayer for bail as he is behind bars since

20.07.2023 in connection with Sessions Case No. 203/2023 arising out of Udharbond Page No.# 2/2 P.S. Case No. 133/2023 u/s 120(B)/302/201/34 IPC.

¶3Heard Ms. A. Begum, learned Addl. PP., Assam

¶4The allegation against the petitioner is that he killed the victim Ashik Uddin Laskar.

¶5The learned counsel for the petitioner has prayed for bail submitting that the petitioner has been languishing in the jail since 20.07.2023.

¶6The learned Addl. PP has raised serious objection stating that the eye-witnesses have implicated the petitioner. Moreover the case is at the fag end of trial. All witnesses have been examined, their statements have been recorded and the case is fixed for hearing.

¶7I have considered the submissions at the Bar with circumspection. This case is at the fag end of trial. It cannot be considered that the petitioner has been languishing in the jail for a prolonged period. The trial is proceeding in a regular pace.

¶8In view of my foregoing discussions, there appears to be no justified ground to admit the petitioner to bail. Petition is rejected at this stage. Send back the Case Diary.
