19.04.2024 Heard Mr. A A Ahmed, learned counsel for the petitioner. Also heard Mr. SK Medhi, learned CGC. The present petition is filed under Section 11 of the Arbitration and Conciliation Act, 1996 for appointment of an arbitrator in terms of the contract agreement No. CON/B-S/2327 dated 24.03.2017. Mr. SK Medhi, learned counsel for the respondent Railways submits on instruction that the Railways shall have no objection, if an arbitrator from the panel of arbitrators in term of notification No. 1999 issued by the Registry of this court, is appointed. The parties have also agreed to the name of Smt. Chaya Rani Goswami, retired District and Sessions Judge, Assam as the arbitrator. In view of the aforesaid consensus, the present application stands allowed by appointing Smt. Chaya Rani Goswami, retired District and Sessions Judge, Assam as arbitrator. Registry will forward a copy of this order to Smt. Chaya Rani Goswami, retired District and Sessions Judge, Assam and parties shall appear before the learned arbitrator.
