Heard Mr. A.Z Ahmed, learned counsel for the applicants and Mr. D Das, learned Addl. PP, Assam. Page No.# 2/2 By this application under Section 438 Cr.P.C., the applicants, namely, 1. Nadu Miah & 2. Shorif Miah have prayed for pre arrest bail apprehending arrest in connection with Mankachar PS Case No.452/2023 under sections 148/149/447/326/307/294 IPC. Case diary called for is received and perused. The eye witnesses' statement suggest involvement of the applicants in the commission of the offence. The injury report reveals grievous injuries and also reflects that such injuries were caused by dangerous weapons. Considering the matter in entirety, this court is of the view that there are sufficient incriminating materials against the applicants including the injury report and accordingly, this Court is of the view that this is not a fit case for grant of privilege of pre arrest bail to the applicants and accordingly the same stands rejected. Accordingly, the instant petition stands dismissed. The interim order passed earlier if any, stands vacated. Return the case diary.
