HON'BLE MR. JUSTICE KARDAK ETE

15.07.2024. (Vijay Bishnoi, CJ)

The matter comes up for consideration of the I.A. (Civil) No.1116/2024, with the prayer to condone the delay of 265 (two hundred and sixty five) days in filling the connected Writ Appeal. It is noticed that the learned Single Judge has disposed of the Writ Petition (C) No.3097/2023, preferred on behalf of the Non-Applicant No.2 Monjit Roy, simply issuing a direction to the Governing Body of the Assam Valley School/ Page No.# 3/3 Respondent No.4 in the Writ Petition, to consider and dispose of the Appeal preferred by the Non-Applicant No.2, in accordance with the law, within a period of two (2) months from the date of receipt of copy of the order. Having noticed that, we are of the view that since the learned Single Judge only directed the Respondent No.4 in the Writ Petition to dispose of the Appeal filed on behalf of the Non-Applicant No.2, no case for interference is made out. Hence the application for condonation of delay as well as the Writ Appeal No.4225/2024 (Filing Number) are disposed of. The applicants here-in are granted a month's time to dispose of the Appeal, preferred on behalf of the Non-Applicant No.2, from today.
