Judgment

ORDER Date : 22.07.2024

Heard Mr. A. Ali, the learned counsel for the Petitioner and Mr. A. Bhattacharjee, the learned Standing counsel appearing on behalf of the Respondent No.1. I have also heard Mr. N. Goswami, the learned Government Advocate appears on behalf of the Respondent No.2.

¶2The instant writ petition has been filed by the Petitioner being aggrieved by the inaction on the part of the Respondent No.2 in furnishing the certified copies of the applications filed by the Respondent No.3 for maintenance which have been registered and numbered as FC (Crl.) Case No.718/2019 as well as also the execution application which has been registered and numbered as Ex. (Crl.) Case No.70/2022.

¶3This Court is of the opinion that if the Petitioner had applied for the certified copies of those applications which have been duly filed before the Court, the Petitioner ought to have been granted the said copies. Without however expressing anything on the merits, this Court directs the Respondent No.2 to supply the certified copies of the applications registered as FC (Crl.) Case No. 718/2019 and Ex. (Cr.l) Case No.70/2022 to the Petitioner forthwith and not later than 5 (five) days from the date of submission of a certified copy of the instant order.

¶4It is however made clear that the order passed herein shall not in any manner be understood that this Court had expressed any opinion as regards the ex-parte proceedings decided and pending before the Page No.# 3/3 learned Family Court.

¶5With above observations and directions, the instant petition stands disposed of.
