Judgment

ORDER Date : 27-05-2024

Heard the learned counsel for the parties. By this application under Section 439 Cr.P.C., the applicant, namely, Nizamuddin Khan @ Nizam Munchi has prayed for granting bail who is in custody since 09.03.2024 in connection with Page No.# 2/2 North Lakhimpur PS Case No.44/2024 corresponding to GR Case No.132/2024 under Sections 489(A) /489(C) IPC. The case diary called for is received and perused. The investigating authority has collected sufficient incriminating materials against the present petitioner. The material so far collected also suggests that the petitioner is a part of a larger group dealing with manufacturing and distribution of fake currency note. As urged by Mr. HR Choudhury, learned counsel for the petitioner it is correct that no recovery has been made from the petitioner, however, the materials collected by the I/O suggests that the petitioner is part of the group who is dealing with such fake currency notes. The fake Indian currency notes so recovered was to the tune of Rs.37,88,000 (thirty seven lakhs eighty eight thousand). The case diary further reveals that there may be some other persons also who are involved in the crime and the police are trying to apprehend them. Considering the stage of investigation and also considering the nature of allegation and involvement of the petitioner, this court is of the view that the petitioner has failed to make out a case for bail and accordingly the present bail application stands dismissed. Return the case diary.
