Hatneilhing Kuki v. The State of Assam

ORDER Date : 08.04.2024 Heard Ms. B.S. Goyal, learned counsel for the applicant Hatneilhing Kuki. Also heard Mr. P.S. Lahkar, learned Addl. P.P. Assam for the State respondent. It is submitted that vide order dated 07.02.2024 an interim bail was granted to the applicant for treatment for a period of 60 (Sixty) days and the applicant was directed to surrender before the learned Trial Court on or before 08.042024. It is submitted that the applicant was released from the jail on 12.03.2024 and thereafter she went to the GMCH Orthopaedic (OPD) on 18.03.2024 but she was told that she was late and doctor will not Page No.# 2/2 be available and was asked her to visit on Thursday as Orthopaedic (OPD) is available only on Mondays and Thursdays. On 21.03.2024, she again visited the GMCH and she was advised several tests to be conducted and in this manner her treatment was delayed. The applicant is still under treatment and has prayed for regular bail for proper treatment. The learned Addl. P.P. has raised objection against the prayer of the applicant to allow the interim bail to be made absolute but has submitted that the interim bail may be extended for her treatment. I have considered the submissions at the bar with circumspection. Considering the health condition of the applicant, the interim bail granted on 07.02.2024 is extended for another period of 30 (thirty) days and the applicant is directed to surrender before the trial Court on or before 08.05.2024. In terms with the above observations, this I.A.(Crl.) is disposed of. List the B.A. No. 293/2024 on 13.05.2024.
