Madhab Boruah v. The State of Assam

10.04.2024 Heard Mr. M. Biswas, learned counsel for the petitioner as well as Mr. R R Kaushik, learned Additional Public Prosecutor, Assam. By this application filed under Section 439 CrPC, the petitioner namely Madhab Boruah has prayed for release on bail, who was arrested in connection with Moranhat P.S. Case No. 09/2024 registered under sections 379/411/413/353/34 of the Indian Penal Code read with Section 11(a)/(d) of Prevention of Cruelty to Animal Act, 1960. Page No.# 2/2 The allegation made against the petitioner is that two cows were found in a vehicle, driven by the petitioner. The cows were subsequently recovered. It is submitted that the petitioner is in custody for the last 34 days. Considering the period of detention already undergone by the petitioner and considering the circumstances under which he was arrested, the bail application is allowed. Accordingly, the petitioner Madhab Boruah, who was arrested in connection with Moranhat P.S. Case No. 09/2024 registered under sections 379/411/413/353/34 of the Indian Penal Code read with Section 11(a)/(d) of Prevention of Cruelty to Animal Act, 1960 shall be released on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Charaideo at Sonari. The bail application is disposed of.
