Judgment
ORDER Date : 10.04.2024 Heard Ms. M.R.Devi, learned counsel appearing for the petitioner. Also heard Mr. K.K. Kaushik, learned Additional P.P. for the State of Assam. This is an application under Section 439 of the Cr.P.C. in respect of NDPS Page No.# 2/2 Case No.84/2023 pending in the Court of the Sessions Judge(M), Guwahati. The petitioner is facing a trial for possession of narcotic drugs. Out of the 7 witnesses, 5 witnesses have already examined. Only two witnesses are yet to be examined. I find that the trial is at the stage of conclusion. This court is of the opinion that if the petitioner is released on bail, it would hamper the disposal of the case before the trial court. Accordingly, the bail application of the petitioner is found to be not satisfactory and stands rejected accordingly.
