¶2On perusal of the order dated 08.12.2023 passed by this Court in WP(C)No.7860/2022, it is seen that the petitioner was directed to approach the Secretary to the Government of Assam in the Secondary Education Department by way of filing an appropriate application for redressal of his grievance. This Court, accordingly, directed the Secretary to the Government of Assam in the Secondary Education Department to do the needful and if necessary by giving a hearing to the petitioner as well as to other parties, who may be involved in the matter.

¶3Accordingly, it is seen that the direction as issued is to the Secretary to the Government of Assam in the Secondary Education Department. The petitioner has not approached the Secretary to the Government of Assam in the Secondary Education Department, but has preferred a representation before the Director of Secondary Education Department, Government of Assam on

27.12.2023 and by alleging that the order passed by this Court vide order dated

08.12.2023 has been violated, the present contempt petition has been filed.

¶4As noted hereinabove, the direction is to the Secretary to the Government of Assam in the Secondary Education Department, which is now Department of School Education and the petitioner not having approached the said authority, no willful and deliberate violation can be held to have occasioned in the matter.

¶5In view of the above, the present contempt petition is closed by granting liberty to the petitioner to approach the Secretary to the Government of Assam, Department of School Education, in terms of the directions as passed by this Court vide order dated 08.12.2023 in WP(C)No.7860/2022.
