Judgment
ORDER Date : 10.04.2024 Heard Mr. N. Mahajan, learned counsel appearing for the petitioner. Also heard Mr. K.K. Kaushik, learned Additional P.P. for the State of Assam. By these two applications, the petitioner Pranjit Saikia who was arrested in connection with All Women P.S. Case No. 20/2024 prayed for releasing him on bail. On the other hand, the petitioner Rizwan Yasin filed a petition under Section 438 Cr.P.C. praying for anticipatory bail in connection with the same police station. One girl fell in love with the petitioner Pranjit Saikia. They had physical relationship. The girl now alleges that Pranjit Saikia had actually raped her and for marrying her, he demanded cash amount of amount Rs. 20 lakh and a Fortuner car. The girl says that on enquiry she found that the petitioner Pranjit Saikia has been doing same act with many girls. Page No.# 3/3 The girl has alleged that the petitioner Rizwan Yasin had prepared a marriage certificate showing that the girl was married to Pranjit Saikia. The girl says that it was a fake marriage certificate as she never married Pranjit Saikia. I have considered the submissions made by the learned counsel for the petitioners as well as Mr. Kaushik, learned Addl. P.P. for the State of Assam. This Court is of the opinion that the petitioner Pranjit Saikia does not deserve to be detained in custody for any further period of time. His bail prayer is allowed. Accordingly, it is hereby directed that the petitioner Pranjit Saikia shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (Metro). So far as the case regarding Rizwan Yasin is concerned, this Court is of the opinion that he does not deserve to be detained in custody for the allegations brought against him. Therefore, his bail petition is allowed. It is hereby directed that in the event of arrest in connection with All Women P.S. Case No. 20/2024, the petitioner Rizwan Yasin shall be released on bail of Rs.20,000/- with a surety of like amount to the satisfaction of the arresting authority. Both the bail petitions are disposed of accordingly.
