Kurban Ali and 4 Ors v. The State of Assam

ORDER Date : 20.04.2024 Heard Mr. S.M. Abdullah P, learned counsel for the petitioner. Also heard Mr. K.K. Parasar, learned Additional Public Prosecutor for the State respondent. This is an application for correction of the Cause Title of the Anticipatory Bail application No.858/2024, wherein the police station of all the petitioners was wrongly typed as Samaguri Police Station instead of Kaliabor Police Station. It is further submitted that all the accused petitioner were granted with the interim pre-arrest bail vide order dated 03.04.2024. But at the time of appearance of the petitioners before the Investigating Agency, it has come to the notice of the petitioners that the police station is wrongly mentioned as Samaguri Police Station, for which the present petition is filed for correction of the Cause Title of AB No.858/2024. In this context, learned Additional Public Prosecutor has raised no objection. Accordingly, the present petition is allowed with a direction to amend the Cause Title of AB No.858/2024 and to put the proper police station as Kaliabor Police Station instead of Samaguri Police Station which is written wrongly due to inadvertent mistake. Further it is submitted by the learned counsel for the petitioner that 7 days time was granted to the petitioners to appear before the Investigating Agency but due to inadvertent mistake in the address of the present petitioners, they could not appear before the Investigating Agency and therefore, pray to extend further 7 days time for their appearance. Accordingly, the petitioners shall appear before the concerned Investigating Agency as per order Page No.# 3/3 dated 03.04.2024 within seven days from the date of the order. With the above observation and directions, the I.A. stands disposed of.
