Md. Alimuddin and 3 Ors v. The State of Assam

O R D E R

03.05.2024 Heard learned counsel for the parties. This is an application filed under Section 439 Cr.P.C. praying for granting regular bail to the petitioners, 1. Md. Alimuddin, 2. Md. Nasiruddin, 3. Md. Basiruddin and 4. Md. Maklesh Uddin, who were arrested on 29.03.2024 in connection with Sonapur Police Station Case No. 55/2024 under Sections 143/144/147/325/326/307/506/34 IPC. Case diary produced by the learned Additional Public Prosecution is perused. Considering the material so far collected and stage of investigation, this Court is of the opinion that further custodial detention of the petitioners is not required in the present case. Accordingly, the present application is allowed. It is directed that the applicants be released on bail on their furnishing a personal bond in the sum of Rs.20,000/- (Rupees Twenty Thousand Only) each with one solvent surety of like amount to the satisfaction of the learned CJM, Kamrup (M) with the following conditions.

(1) The petitioners shall not hamper with the investigation, or tamper with the evidence of the case,

(2) The petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer,

(3) The petitioners shall appear before the I/O on each and Page No.# 3/3 every date as and when called for. Bail application stands disposed of.
