ORDER Date : 08.05.2024

¶1Mr. B. Choudhury, the learned counsel appearing on behalf of the Petitioner submits that the Petitioner herein does not want to press the instant petition. He further submits that he may be given the liberty to file necessary application Page No.# 2/2 before the Court of the learned Additional District Judge No.2, Kamrup (M) at Guwahati before whom the proceedings under Section 34 of the Arbitration and Conciliation Act, 1996 is pending and to make appropriate submissions as regards certain concessions.

¶2Taking into account the above, the instant petition stands closed on withdrawal.

¶3The withdrawal of the instant application shall not preclude the Petitioner to approach the Court of the learned Additional District Judge No.2, Kamrup (M) at Guwahati to seek certain accommodation for the purpose of depositing the amount so directed. It is observed that if such petition is filed, the learned Court below shall consider the same as per the provisions of law without being influenced by the leave so granted.
