It is submitted by the learned counsel for the petitioner that though the case was registered under Section 20(b) of NDPS Act but the quantity recovered from the petitioner is 0.839 kg which is small quantity for which section 20(a) is attracted in this case instead of Section 20(b) of NDPS Act. On the other hand, Mr. Goswami, learned Additional Public Prosecutor for the State has submitted that small quantity of suspected ganja was recovered from the possession of the petitioner. Therefore, considering the nature of offence, the prayer of the petitioner may be considered. I have considered the submissions made by the learned counsel for the parties. Perused the record.
