ORDER Date : 08. 05. 2024 Heard Mr. M. Sarania, learned counsel for the petitioner and Mr. R.R. Kaushik, learned Addl. P.P. for the State respondent. This is an application for modification or alternation of the order dated

19.06.2023, passed in AB No. 2598/2022. Page No.# 2/2 It is submitted by the learned counsel for the petitioner that though the petitioner was directed vide order dated 19.06.2023, passed in AB No. 2598/2022 to appear before the trial Court within 15 days from the date of the order but the petitioner was not in a position to appear before the trial Court due to his subsequent ailment and treatment. Accordingly, the learned counsel for the petitioner prays for extension of time to appear before the trial Court. The learned Addl. P.P. has raised objection by stating that the order was passed one year back and the grounds shown by the petitioner were not satisfactory. I have gone through the medical report of the petitioner which reveals that the petitioner was not suffering from such severe illness for which he could not appear before the trial Court within almost 1 year. However, the petitioner is directed to appear before the trial court on or before 13.05.2024, failing which the order passed in this I.A. will be treated as cancelled. The trial Court is at liberty to pass any such appropriate order to procure attendance of the accused/ petitioner. The I.A. stands disposed of. This order shall be a part of order dated 19.06.2023, passed in AB No. 2598/2022. JUDGE Comparing Assistant
