Manoj Basfor v. The State of Assam

¶1Heard Mr. K. Bhattacharjee, learned counsel for the petitioner.

¶2This is an application under Section 438 of the Code of Criminal Procedure, 1973, praying for grant of pre-arrest bail to the accused/petitioner, namely, Page No.# 2/2 Manoj Basfor who is apprehending arrest in connection with Latashil P.S. Case No. 30/2024, under Sections 120B/420/465/467/468 of the Indian Penal Code.

¶3The FIR was lodged by Smt. Chanda Basfor that a railway employee Manoj Basfor promised to provide a loan from SBI and he took documents such as Aadhar Card, PAN Card, Voter ID, Passport size photographs from the informant Chanda Basfor. Being an illiterate lady and believing Manoj Basfor she handed over her documents and taking advantage of her illiteracy, the petitioner Manoj Basfor got a loan of Rs. 12 lacs sanctioned in the informant's name and he fraudulently paid only Rs. 50,000/- to the informant. It is also alleged that the bank officials are also involved in this financial scam.

¶4Heard Mr. B.B. Gogoi, learned Addl. PP, Assam.

¶5I have scrutinised the Case Diary. I have also scrutinised the statements of the witnesses u/s 161 Cr.PC. At this juncture I am not inclined to grant bail to the petitioner. The merits of the case are not brought to the fore.

¶6As investigation is still under progress, petition is rejected at this juncture. Send back the Case Diary.
