Darshana Bharadwaj v. The State of Assam

ORDER Date : 20-05-2024 Heard the learned counsel for the parties. This is an application under section 439 of the Cr.P.C praying for release of the petitioner namely, Darshana Bharadwaj on bail, who was arrested on 02.04.2024 in connection with Page No.# 2/3 Tezpur PS Case No.167/2024 under sections 120(B)/420/506 IPC. The allegation made in the FIR is that the petitioner introduced herself to be a person who can provide job at Northeast M.E.S on contractual basis and she asked the informant to arrange for 30 numbers of such job. Accordingly the informant arranged 23 persons from Dibrugarh and 7 persons from Tezpur who were interested in doing such contractual job. Accordingly altogether 17 appointment letters were handed over to the informant and it was informed that other appointment letters had not yet been received from Northeast M.E.S. In lieu of such appointment the informant was demanded Rs.50,000/- each and altogether Rs.1,50,000/-, through online payment method, were made in favour of the accused for issuance of such appointment. Subsequently, the informant came to learn that all those appointment letters were fake and fraudulent. Accordingly FIR was lodged and the petitioner was arrested. The case diary called for is received and perused. From the materials available on record, this court is of the prima facie view that there is a group, who is luring unemployed persons by offering jobs and extracting money by issuing fraudulent appointment order. Another person namely Nangal Singh is the main kingpin in the entire racket and he has not yet been arrested. Considering the matter in entirety and stage of the investigation, this court is of the view that further custody of the petitioner may be necessary for investigation of the case. Page No.# 3/3 Accordingly the bail application stands dismissed. Return the case diary.
