Dharmeswar Kalita v. Bulo Kalita

ORDER Date : 11.05.2024 The case is put up before the National Lok Adalat today. The petitioner Sri Dharmeswar Kalita and the respondent Smt. Bulo Kalita are personally present before the Court today. This revision petition has been filed by the petitioner impugning the order dated 28.06.2022 passed by the learned JMFC, Baksa in M.R. Case No. 43/2019 Page No.# 2/2 under Section 125 of the Code of Criminal Procedure whereby the present petitioner was directed to pay maintenance amount of Rs.4,000/- per month to the respondent, who is the lawfully married wife. It is stated by both the parties that the petitioner is now regularly paying the maintenance amount of Rs.4,000/- to the respondent. However, an arrear of Rs.1,32,000/- has been accumulated and today it has been amicably agreed between both the parties that the petitioner Sri Dharmeswar Kalita shall continue to pay regularly the maintenance amount of Rs.4,000/- to the respondent and against the payment of accumulated arrear he shall pay an additional amount of Rs.2,000/- per month. Thus, he will pay the amount of Rs.6,000/- per month to the respondent till the arrear amount is liquidated. After full payment of arrear amount, he shall continue to pay the awarded amount of Rs.4,000/- to the respondent. As per the amicable settlement reached between the parties, this case is disposed of on withdrawal on terms of settlement as detailed herein above agreed upon between the parties. This case is accordingly disposed of.
