The present writ petition is filed by the informant in Dispur PS case No. 3570/2017 registered under Section 120B/420/406/468/471 IPC. The prayer made in this writ petition is for direction to the State respondent to cause an honest, prompt and efficient investigation of the matter and a direction to the respondent authorities to submit the charge-sheet as per Section 172(2) of the Cr.P.C. 1973 at the earliest. The learned State counsel has obtained status report from the Deputy Commissioner of Police (Crime), Guwahati, which shows that after completion of the investigation the case has been returned in F/R vide Dispur PS F/R No. 6326/23 dated 30.12.2023 by the IO Sri Jishu Janakya Gogoi and the original case diary along with the related documents has already been sent to the jurisdictional Magistrate. In view of the aforesaid and in the backdrop of the prayer made, in the considered opinion of this court, nothing survives to be adjudicated in the present case. Accordingly, the writ petition stands closed. However, the petitioner shall be at liberty to agitate his grievance against such F/R filed before the learned jurisdictional Magistrate as per law.
